Purposes and legal bases for data processing in accordance with Art. 13 (1) (c) GDPR

Personal data are processed for the purpose of performing contracts or implementing pre-contractual measures. This includes customers’ basic data with contacts as well as contact history, offers, orders, invoices, project details and other statutory obligations of the controller.

The legal bases can be found in Art. 6 GDPR. Further significant legal bases can be found in the German Commercial Code (HGB), tax legislation, the German Companies Act (GMBH-Gesetz) and further statutory provisions applicable to badgetec® GmbH. This also includes contractual regulations. Newsletters are processed on the basis of the data subject’s consent.

Processing is necessary in order to protect the legitimate interests pursued by the controller or by a third party in accordance with Art. 13 (1) (d) GDPR

Where necessary, we process your data beyond the actual performance of the contract in order to protect our legitimate interests or those of third parties. These interests include:

auditors, court bailiffs and other creditors; other state agencies for compliance with statutory obligations and for required certificates; logistics companies; customers; suppliers and other agencies and business partners.

Third countries including adequacy decision in accordance with Art. 13 (1) (f) GDPR

Within the framework of international business relationships, data are transferred in accordance with Art. 6 (1) (b) for the purpose of performing contracts or implementing pre-contractual measures. No adequacy decision is needed here.

Storage period in accordance with Art. 13 (2) (a)
The respective purposes can be found in the statutory provisions and in relevant sector-specific standards. Personal data are erased after the purpose has been achieved.

The data subject’s rights in accordance with Art. 13 (2) (b)
You can exercise your rights at any time using the contact details set out above. If your personal data are processed, you are the data subject within the meaning of the GDPR and you are entitled to assert the following rights against the controller:

References to the rights of the data subject
The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the information listed in Art. 15 GDPR.
The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her and, where appropriate, to have incomplete personal data completed (Art. 16 GDPR).
The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay if one of the grounds listed in Art. 17 GDPR applies, e.g. if the data are no longer required for the intended purpose (right to erasure).
The data subject shall have the right to obtain from the controller restriction of processing where one of the conditions listed in Art. 18 GDPR applies, e.g. if the data subject has objected to processing, for the period of the controller’s investigation.
The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time, to the processing of personal data concerning him or her. The controller shall then no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims (Art. 21 GDPR).

The data subject’s rights in accordance with Art. 13 (2) (c) GDPR
If you have given consent for us to process personal data for specific purposes (e.g. processing data subjects’ images), the lawfulness of this processing is based on your consent.
Any consent that has been given can be revoked at any time. This also applies to the revocation of consents that were given to us before the GDPR came into force, i.e. before 25 May 2018.
Please note that revocation only takes future effect. Processing that has been carried out before the revocation is not affected by this.

Right to lodge a complaint with a supervisory authority in accordance with Art. 13 (2) (d) GDPR

Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority if the data subject considers that the processing of personal data relating to him or her infringes the GDPR (Art. 77 GDPR). Revocation of your consent to the processing of data

Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Registration on this website

IP anonymization

On this website, we have activated the IP anonymization function. We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Demographic parameters provided by Google Analytics

This website uses the function “demographic parameters” provided by Google Analytics. It makes it possible to generate reports providing information on the age, gender and interests of website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data”.

Archiving period

This website uses the analysis service etracker. The provider of this service is the etracker GmbH, Erste Brunnenstraße 1, 20459 Hamburg, Germany.
